Tips To Avoid Trademark Rejection By The Directorate Of Trademarks And Geographical Indications (DJKI)

In the event that your brand receives an Official Letter of Trademark Rejection from the Directorate General of Intellectual Property (DJKI) in Indonesia, there are several steps you can take to address the issue:

  1. Identify the Issue: Determine whether the rejection is due to similarity with another trademark, lack of novelty, unclear description, or other reasons.
  2. Prepare and Submit a Response: Submit your response to the Directorate of Trademarks within a maximum of 30 (thirty) days from the date of receipt of the rejection notice. Ensure that the response is sent according to the procedures set by DJKI.
  3. Appeal: If your response is not accepted and you wish to proceed, prepare the necessary documents and information for an appeal.
  4. File a Lawsuit with the Trademark Appeal Commission: If you believe your trademark should be accepted and the appeal is denied, you may file a lawsuit with the Trademark Appeal Commission.
